About these terms

These Terms and Conditions ("Terms") govern the supply of website design, development, and hosting services by mk1studios, operated by David Boland, 82 Cardigan Road, Bridlington, East Yorkshire, YO15 3JT ("we", "us", "mk1studios"). By engaging our services or signing an order form you agree to be bound by these Terms. We recommend you read them carefully before proceeding.

Our services

We offer website design and development on a subscription basis across several plans. The Launchpad plan provides a single-page custom-designed website including a contact form, delivered at no setup charge. The Starter, Business, and Premium plans provide multi-page bespoke websites and are scoped individually. All plans include managed web hosting for the duration of your subscription. The exact deliverables for your engagement are agreed in writing before work commences.

The Launchpad plan — specific terms

The Launchpad plan includes: one custom-designed single-page website; one contact form; mobile-responsive layout; basic on-page SEO setup; and managed web hosting. There is no design or build fee. A monthly hosting charge of £20 (total payable — no VAT is charged) applies from the date your website goes live, or no later than 30 days after we deliver a draft for your approval, whichever is sooner. The Launchpad plan is subject to a minimum contract term of 12 months. After the initial 12-month term, the plan automatically continues on a 30-day rolling basis until cancelled by either party in accordance with clause 7.

Domain names

You may provide your own registered domain name. If you choose to do so, you remain the sole registrant and owner of that domain, and you are responsible for its renewal. If you require us to register a domain on your behalf, standard .co.uk and .com domains are available from £15 per year. Some domain names — including premium, short, highly sought-after, or non-standard extension domains — may carry a higher registration cost. We will always confirm the exact price in writing before proceeding with any domain purchase. Domain registration fees are non-refundable once a domain has been registered. Where we register a domain for you, we will transfer it into your ownership on request at the end of your subscription, subject to any outstanding balance being settled.

Payment

Monthly hosting charges are payable in advance on a recurring basis. Payment is due on or before the same date each month. We accept payment by bank transfer or such other method as agreed at the time of sign-up. mk1studios is not VAT registered. No VAT is charged on any of our services. All prices stated in these Terms and on our website are the total amount payable. Invoices not settled within 14 days of the due date may attract interest at 8% per annum above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998. We reserve the right to suspend hosting services for accounts more than 30 days overdue until payment is received.

Minimum contract term

All plans carry a 12-month initial term beginning on the date your website goes live. You may not cancel or request a refund during the initial 12-month term. This minimum term reflects the cost of design, development, and setup work that is provided free of charge or at a reduced rate under subscription pricing. After the initial term, the agreement continues on a 30-day rolling basis.

Consumer rights and cooling-off period

If you are a consumer — meaning an individual entering into this agreement wholly or mainly outside your trade, business, craft, or profession — you have the right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2014 to cancel this contract without reason within 14 days of the date the agreement is entered into (the "cooling-off period"). To exercise this right, you must notify us in writing at david@mk1studios.co.uk before the cooling-off period expires. If you request that we begin work during the cooling-off period and you give your express consent to waive your cancellation right in respect of services already performed, you may lose the right to cancel for that portion of completed work and may be charged a reasonable amount in proportion to what has been delivered. If you cancel within the cooling-off period and no work has commenced, we will issue a full refund within 14 days of receiving your cancellation notice. These consumer cancellation rights are in addition to, and do not affect, any other rights you may have under applicable law. If you are contracting in the course of a business, these cooling-off rights do not apply.

Cancellation

After the initial 12-month term, either party may cancel the agreement by providing 30 days' written notice to the other party. Notice should be sent by email to david@mk1studios.co.uk. Upon cancellation taking effect, we will provide you with all website files and assets in a standard format so you may continue with another provider. Hosting will cease at the end of the notice period. No refunds are issued for partial months already billed.

Hosting and uptime

We take reasonable steps to ensure your website remains available and performant. Hosting is provided via our chosen infrastructure partner (currently IONOS). We do not guarantee 100% uptime but will act promptly to resolve outages within our control. Planned maintenance will be communicated in advance where possible. We are not liable for outages caused by third-party infrastructure failures, force majeure events, or circumstances beyond our reasonable control.

Intellectual property

Upon receipt of all sums due under your contract, full ownership of the website design and content created by us passes to you. We retain the right to display completed work in our portfolio and use it for promotional purposes unless you request otherwise in writing. Any third-party assets (stock imagery, fonts, or plugins) remain subject to their respective licences. You warrant that any content, images, or material you supply to us does not infringe the intellectual property rights of any third party.

Your responsibilities

You agree to provide accurate business information, brand assets, and feedback in a timely manner to allow us to complete your website. Delays caused by you may affect project timescales. You are responsible for ensuring the content of your website complies with all applicable laws and regulations, including (without limitation) consumer protection, advertising standards, and data protection legislation.

Limitation of liability

To the fullest extent permitted by law, mk1studios' total liability to you in connection with any services shall not exceed the total fees paid by you in the 12 months preceding the claim. We are not liable for any indirect, consequential, or economic loss including loss of profit, loss of business, or loss of data. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other matter that cannot be excluded by law.

Termination for cause

Either party may terminate the agreement immediately by written notice if the other party commits a material breach of these Terms and (where the breach is capable of remedy) fails to remedy it within 14 days of a written notice requiring remedy. We reserve the right to terminate and remove your website immediately, without notice, if your site is used to host unlawful content or engage in activity that may bring mk1studios into disrepute.

Changes to pricing and services

We reserve the right to revise our prices or service terms. Where a change adversely affects you during your current contract term, we will give you no less than 60 days' written notice. If you do not accept the change, you may cancel with effect from the date the change takes effect, notwithstanding any minimum term.

Governing law

These Terms are governed by the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
